Threre are no changes regarding this bug in the mainline-kernel.
I tested it with this one:
http://kernel.ubuntu.com/~kernel-ppa/mainline/v3.9-raring/ which seems to be
the latest version available for raring at the moment.
$ uname -a
Linux yeah 3.9.0-030900-generic #201304291257 SMP Mon Apr 29
** Tags removed: needs-upstream-testing
