I've build a recent binutils snapshot with your patch on cygwin. The described
error does not occur, it looks to me that this patch solves the problem.

Just a few more notes after more digging into this stuff:
- I found a technology preview of gcc 4 for mingw, which is usable.
- a testcase I wrote for cygwin/mingw-gcc4 and mingw-gcc4 showed that
