after two glasses of wine, take this advice for what it's worth.  tell 
them you're going to sue.  make a very careful (notarized if possible)
record of the fact that, as of this minute, that domain is expired.
record the fact that you tried to register it and were refused, and
were not given a reason.

now, assuming that they're still not going to budge, sit back and
check in on that domain on a regular basis.  the instant it is assigned
to someone else, *now* you haul their asses into court, with evidence
that you tried to register *before* the current domain owner.

this situation is not new -- it's been going on for some time, and
verisign are little more than thieves.  i know -- they scammed me in
a weak, inattentive moment bu sending out letters that *looked* like
renewal forms but were, in fact, domain transfer forms, and i got
suckered.

if there were any justice, the people who run verisign would be in
the cell next to ken lay, bernie ebbers, dick and george and five
justices of the u.s. supreme court.

but, hey, that's probably just the wine talking.
