Actually, just making the encoding match the XML declaration, if one is present, would be a lot easier...

So that's what the specification currently states. Encode it according to data.xmlEncoding. Where data is the Document object you passed to send(). Since xmlEncoding is directly derived from the XML Declaration I guess this is a non-issue and Firefox just has to fix its bug?
