Possibly easy to find out.  Can you reproduce without perl being
involved as I did previously?

I made it through 10,000 rounds of "file" with that shell script and
didn't get any failures on an older -current with libmagic-5.31.

But, I also don't get any failures with the script you provided on a
similar setup to sthen.
