Yup. That are good reasons to keep the list open. I think a filter for the crap should do it. Just block every UTF-8 (?) encoded e-mail and send them a message why they are blocked (with some challange to reply by using an invalid sender and an _only_ human-readable notice in the e-mail with a correct e-mail adres).
This is not a general solution, but just a good fix for this specific kind of annoying spam.
