No, ist'not a php limit. The upload is written in main memory, if i look with vmstat, free is going to 0 and the php upload breaks at 0 bytes free. Nothing swap used. Any other ideas?

It doesn't need to - as you've noticed, the uploaded file is being written to disk, it's not being kept in memory.
