If you upload pictures with the conditions that they have set in the
agreement, then they would be in the clear to use the pictures without
payment.  As you say, it's exceedingly unlikely, but they could.

Generally what you are doing is granting them a non-exclusive usage
license that allows them to basically do whatever they want with the
pictures.  As Mark's excellent blog post points out though, it's far
more trouble than it's generally worth to try to exploit the pictures
for direct monetary gain.  Displaying them is usually the extend of
how they use them.
