Nope, what you have is the same thing as with Apple Computer, and Microsoft. 
When Apple tried suing MS over Windows, the they lost because they didn't own 
the technology, it belonged to Xerox who they borrowed it from (some would say 
stole). In other words Getty can sell it but they can not stop someone else 
from doing the same. That is what "Public Domain" means.

Getty claiming copyright is just a lie to try and get the gullible to pay them 
every time they use the image. It is as legal as those nifty license agreements 
on software that you don't see until after you pay for it. Not binding at all.
