Yes, try to escalate the issue. Sometimes asking over the phone for a legal department rep works wonders.
They have zero upside incentive to cooperate with you, so do beat them on the head and get them all the downside you can think of to make them work with you. And, yes, Pentax has everything to do with this. It is them who hired the 3rd party.
