It's only a false dichotomy when taken out of context. You left out my supporting argument. That renders your critique of the argument fallacious.

this is a false dichotomy which could be used to justify absolutely any
state action.
It arises from the following chain of faulty reasoning:

Something must be done. This is something. Therefore this must be done.
