In the US you can certainly be sued, but whether the suit gets thrown out
for lack of merit, or is adjudicated favorably, are different matters
entirely.  Actually, if the rider was truly minding his own business, he
wouldn't have been paying attention to some fellow on the sidewalk with a
camera.
