If it happened to me (in the state of California), I would first find the sales receipt for the item, check how long ago I bought it, check warranty conditions, and start on a course of seeking a refund or exchange. The usual warranty period on an item like that is 1 year (here in the UK), so what is the warranty period? As Mike mentioned, if something still breaks even after a year (here in the UK), then there is still provision within the law to follow up. An item has to be fit for the purposes for which it was sold. People have chased the makers of faulty goods through the small claims courts here with some success. It is time, but if successful, it isn't money (costs can be claimed, including damages). Now if the thing is only worth a hundred bucks and it is three years old, well, possibly learn from the experience and by all means point out the inadequacies of the brand to colleagues and friends, but this is the internet - there are eyes everywhere ;-) Best, Cheers, Cotty ====== $200, less than a year old, died on four uses. Well, Cotty, I had no idea I might have it replaced after having bought it over six months ago, so my only recourse seemed to be to badmouth someone. I HATE it when something breaks with just a few uses. And I don't consider $200 cheap. Besides, badmouthing is fun. But, yes, I am now going to see if I can get a refund or another image saver, not necessarily the ImageTank. I really don't want a replacement, see, and that is usually what a store would do.
