Sounds like illumos bug or something,
If you are running latest illumos e.g. with Openindiana hipster install
then update to latest,
(I do it by installing in Virtualbox and zfs send/receive to the host to
have both /dev and hipster-2015),
then you can post a bug for illumos:

or, better you post a bug for OI to decide, putting [hipster] in subject
line:
