I tried to distribute the binary rpm before but members of the kernel development project that are on the list took offense as the driver would be considered a derivative work of the kernel and so can only be distributed if all the source is there and it complies to the GPLv2 license. The Broadcom STA driver as it stands is not a GPL driver. I respected the request to not distribute the binary driver. Also, I think that there are clauses in the license that Intel where worried about and that's why it can't be redistributed even in the non-oss repo.
