I guess the quote from the Playboy VP on that page could be read as the copyright holder authorizing redistribution. But that's still far from DFSG-compliant, of course. I'd suggest putting a fallback copy at fate, and then just purging the file from the debian package. BTW, this standard test image was eliminated from undergraduate courses at some Swedish universities some year ago, not because of copyright concerns, but because it was deemed sexist.
