This problem has not been solved yet it appears. I can confirm it is not working on a Dell Latitude E5440 with Ubuntu 12.04 LTS, kernel 3.11.0-24-generic. The FN-F8 key is still not working correctly. I get similar key scan codes as JeffH posted:
