I can confirm that this issue also happens in windows (The user of the function key button is not required to access the functions! But the FN key is required to use the F1-F12), therefore it's not a Linux Kernel bug, it's actually the laptop/BIOS mapping is incorrect. Therefore this is not an issue for ubuntu / kernel to resolve. Thanks again.
