I swear I replied to this a few hours ago, anyway, in there I said that my Sort By settings are in "No ordering, folders first" and that I was gonna try reproducing it again (as I'd stopped using the icons because they were broken) I can still reproduce this, even after a bunch of formatting and starting over I did in the mean time.
