So, in the future, as required by Olivier, this behaviour (fail if the artifact being deployed is already present) will be the default. FWIW: the code is in the DefaultArtifactDeployer class in the maven-artifact project. The revision that added this behaviour is the 592286 one by Jason. So I guess this bug could be marked as fixed.
