I don't think it is a legal issue. It is an ASF policy that the ASF only officially releases source materials. As Marvin has mentioned many times already, you can't easily audit compiled code to be sure there isn't something wrong with it. For folks in the incubator, IMO it would be to their advantage to take the time to eradicate compiled code from the source package before proposing to release it. It makes the IPMC reviewers job much more efficient.
