There is still no policy for that (or please point me to the policy document). However, iirc the files in the CXF tar ball are generated based on the sub modules in the repository during the build. Not having the LICENSE in the root repository folder doesn't make it unlicensed. It makes it unclear to the person checking out the code directly.
