To me it seems the advice you get depends on who you ask.  Besides being
inconsistent, it also points out to lack of clarity in the license and
trademark policy.

Varying interpretations bug me, speaking here as a use of open source code,
it's hard to adopt something if I can't tell what the licenses actually
mean.  I don't want to be surprised down the road to find out my
understanding was wrong, or get caught between two conflicting opinions.

Those are all forms of friction.

The fact that the question was raised and no one can point to a conclusive
answer on a public page means the policy is unclear.  If those are the
feelings of the ASF, shouldn't they be widely known?
