If you fork outside Apache Software Foundation, yes, you'll have to rename: 
code is free, but the name is owned by ASF.

Incubator is there only for code intended to remain at ASF: if I understand 
correctly, that's not your intent. That's ok.

Just tell us:
- which Attic project you've forked
- where did you put the fork
Then we can update project's Attic page to link to the new location
