libgfortran files are licensed under several licenses: some say GPL, some LGPL, some GPL+exception. This has to be fixed before a release. This msut be fixed before a release.
This has been already discussed on the mailing list in the thread following <http://gcc.gnu.org/ml/fortran/2004-09/msg00005.html>. I'm thinking Toon is working on this, that's why I added him to the CC. He has mentioned a few rules for deciding the license here <http://gcc.gnu.org/ml/fortran/2004-11/msg00155.html>.
