Hi Carolyn! To the best of my knowledge at the moment, (1) Yes, the current work on the API migration to JISC Open Policy is planned to be ported back to DSpace 8.x, and ideally also DSpace 7.x. (2) No, unfortunately the current Sherpa API is planned to fully retire at the end of April (source <https://openpolicyfinder.jisc.ac.uk/whats-new>), so it will probably be necessary to patch older installations.
For everyone's reference, here are the ticket <https://github.com/DSpace/DSpace/issues/12003> and PR <https://github.com/DSpace/DSpace/pull/12005> that are in progress to move to the new Jisc Open Policy Finder API.
