Dr. Brown and List members:
I would be curious to know the answers to these questions when it comes to
the practice of sampling.
1) Does the sampled artist get writing credit and royalties? Are the
sampled artists listed on the album's liner notes?
2) Is permission necessary from the original artist/label in order to be
sampled?
3) How can this blatant practice of lifting another artists work go on when
you have the historical example of George Harrison getting sued for having
a "simular" hook line to the Shirelles in his song "My Sweet Lord"?

Hi guys & gals!
While I was watching some TV prog the other week the incidental music
accompanying one section caught my attention. It was "ambient" or
"chill-out" house type stuff (sorry, too old to know the true
terminology!).
Anyway, I emailed the producer of the prog to find out what it was, chased
it up on the Internet and promptly ordered it - just received it in the
post
today....
I was right! They've used a sample from the beginning of "South City
Midnight Lady" - the first few bars of Pat's guitar playing - and it's not
just played in the style, or a cover - it's actually sampled. The CD is
"View From the Heights " by Neon Heights and Zed J (released May 2000) and
the track in question is "16 Again". If anyone would like to hear what I'm
talking about I could send a small clip of it in MP3 format (about 300K
max.). Just let me know.
Anyway, what I was wondering was, does Pat/the band/the record label see
this as flattery or just plain theft? Or maybe permission was asked?
Does anyone know of any other song that has used a sample from a Doobies'
recording?
