In the meanwhile this defect is tracked by issue 124607 [1].
This issue is fixed on trunk and will be fixed for AOO 4.1.0.
You can open the document in former OpenOffice versions, but the
comments/annotations which are applied to a text range will be only
applied to beginning of the text range.
