I also noticed it depends on file names (?!?!?!). I created 2 files with
the names "1" and "2" and I had a Nautilus Script to compare selected
files. The behavior was exactly as you described. I would select these
two files and then right-click on them. As soon as I right-click the
selection disappears. It worked on the other files though. So I renamed
these files and it worked again.

BTW it is reproducible. Just create 2 files with names "1" and "2" in
the same folder, Ctrl+click-select them and then right-click on the
selection and there you go .........

  In 12.04 nautilus problem with  shift/ctrl multiple file select and
  right click context menu

Status in “nautilus” package in Ubuntu:
  Invalid

Bug description:
  There is a problem when multiple selecting files with ctrl or shift
  and then release and right click to bring up context menu. As soon as
  you right click all your files are unselected again. Only way to
  process these files is to use the panel menu. Very annoying when you
  have painstakingly ctrl selected files to copy or move and then you
  right click and everything un-selects.

  This is regression, never had this issue in Ubuntu before.
