Are you sure this still applies? From what I see on the forum and the homepage http://warzone.berlios.de/index.php/Main_Page it seems that there is consensus that everything except the videos, which are not included in upstream releases is under the GPL. I just tried the current upstream svn. Exept for one typo in the source it compiled out-of-the-box on my Debian unstable. It runs OK, crashes sometimes (usually after some hours of playing) and doesn't show up fullscreen when run under Gnome (fullscreen works with plain X).
