Thanks for your thoughts. I don't tend to view a Debian package as derivative work of the original source since the distributed source code is unmodified. Further, the distributed binary is exactly the same binary as would be produced on a compilation from the original source in a non-Debian sytem. I agree that Debian packages adds information around the source and binary as well as applies compressions. This may, I agree with you, cause it to be considered a derivation. As I put in the ITP, iozone3 should be in non-free. I agree with you it is good to be safe. Thus, I will write to the authors and request written permission to distribute in the non-free section of Debian. BTW, I have the Debian package created and ready to upload.
