ZFS is licensed under the CDDL[1], which is both free (as in freedom) and DFGS *compliant*. It is also *incompatible* with the GPL, which means distributing a Linux kernel (GPL) including the ZFS modules is possibly illegal[2]. End users however are well within their rights (freedom 0 and 1)[3] to use this combination, as long as they don't share it with anyone else (freedoms 3 and 4)[3].
