I was just thinking of a slightly more limited approach: decide that "if the work is covered by DRM, then unless a non-DRMed copy is on file with the central archive, anti-circumvention law does not apply". Going farther than that, to say "if DRM is to be employed, then in order for the work to be eligible for copyright protection, a non-DRMed copy must be filed with the appropriate central archive", would also be possible, and would cover cases with the other would not - but would be considerably less likely to get adopted.
