It is legal to use it to access a DVD you own in the USA as long as you make no infringing copies. The problem is that the CCA contends that the primary purpose of libdvdcss2 is circumvention and so, they contend, distributing it is illegal. If it can be established that its primary purpose in not copyright infringement it will be legal.
