Another possibility would be to consider it the smallest amount of force necessary to prevent an assault. Merely ignoring the attempt could be seen as analogous to trying to walk away when a drunk slaps you. While it's noble, noone would get mad if you held the drunk down until something could be done about the situation. OK, it's a stretch to compare laws concerning physical real-world assault to the virtual assault committed by these infected servers, but could at least a little bit of the principle apply? -- Kirk Strauser
