I think you are mistaking twolame and lame. twolame (and toolame) are encoders for MPEG-2 layer I and layer II, they do not cover MP3 (layer III). Layer II, aka Musicam, was created by Philips and it thus seems pretty unlikely that Fraunhofer would hold any patent rights on it.
