There is nothing magic in this file, so you could do it.

Obsolete configuration files without local changes may be removed by the
package during upgrade. see
http://www.debian.org/doc/debian-policy/ch-files.html#s-config-files 

If /etc/emacs/site-start.d/50magit.el is  conffile dpkg should do it
(well I would test to be sure, but it is what I understood reading the
documentation.)
