Okay, so to summarize:

There are two files in the MTOS distribution which do not include
source and for which there is no copyright/licence in the distribution.
Both files are tightly bound into the software and we cannot easily
remove them.

On not building from the source, and not being able to build with
free tools:

I conclude that it's okay to not build the flash component from source
in the package build, but it is not okay to have the component not
buildable using Free tools and in main. Furthermore, it is not
possible to build either of the two above flash applications with Free
tools. Therefore, the package needs to be moved to contrib or non-free.
