I guess it is a matter of how to interpret:

2. Redistributions in binary form must reproduce the above copyright
   notice, this list of conditions and the following disclaimer in the
   documentation and/or other materials provided with the distribution.

I would personally interpret it as 'the source is provided with the 
distribution, so it is already provided'  rather than 'must be mentioned in 
documentation in the binary package'.

I guess this question should be taken to appropriate maillist rather than this 
bug report. I'm unsure which one.
