The README states that the dietlibc is licensed under GPL-2, which
actually allows to apply any later version.  I do not see anything wrong
here.

 apt-get source dietlibc
 diff -u dietlibc-0.32/COPYING /usr/share/common-licenses/GPL-2

Where do you get the information from that upstream allows GPL v2 only?
