Because it's so small that it is not copyrightable? I think that at
least in the German Law situation, its small size _and_ its properties
(being an executable _and_ printable file, which surely was not easy
to achieve), clearly reaches the "Schöpfungshöhe" to be copyrightable
in Germany.

Are you only hoping, or have you actually tried to get in touch with
them? I have reached the end of my possibilities, which included
personal contacts to someone who knows people at Eicar, without ever
receiving a single bit of response.

Looks like squeeze is being without clamav-getfiles, so there is
really no need to worry any more.
