You should patch debian/patches/67_init_hddown.dpatch, not *.orig. Recompile ("dpkg-buildpackage -rfakeroot") and "dpkg -i sysvinit_*.deb". Shutdown. The warning should be gone. (For me, it works in this situation.)

Yes, the "feature" (sysfs file present) should lead to shutdown _not_ shutting down the drive so the kernel can do it in a safe way.

BTW, I saw other patches applyed in svn branches to init scripts. Are
they not relevant?

Which one do you mean? The latest I saw at the point where you mentioned it the first time, was already months old.
