I experience a similar symptom in that "/etc/init.d/nodm stop" doesn't always work, but I'm not sure it has the same root cause. The init script uses start-stop-daemon with a PID file, so it should always reach the supervisor. Nevertheless stopping nodm sometimes fails, the session just gets restarted.
