If the debconf question about chainloading from menu.lst is answered "no" debconf should present the selection of media to install to. Otherwise installing grub-pc quite hard and error-prone. Since only stable installers are somewhat guarenteed to work and grub-legacy is still the default anyway you have to install a stable system with grub-legacy and then upgrade.
