I had the same issue, the kernel would oops as soon as it loaded the via driver (every time). I did not pull patches out of git, as was requested of the original bug submitter, I just pulled the via-velocity.(c|h) out of 2.6.28, and diffed them against what was in debian's 2.6.26 source package. It did not look like anything would prevent the newer version from being used, so I replaced the via-velocity.* files in the debian source package.
Works great, so far. So, the bug does appear to be an upstream one, that has been fixed. I did this before reading the bug report, but not sure those patches in git would address the issue. Unless I am reading things wrong, it looks like they were committed before 2.6.26 was released. g
