I just had the same problem when upgrading. Since I had seen this bug
before starting my upgrade I did a /etc/init.d/spamassassin stop before
starting the upgrade but still had the same error.

Taking a look it seems that I still had a child that was running:
audio:~/bin# ps waux | grep spam
qscand    2764  0.1 22.0 38156 13432 ?       SN   Jun10   6:11 spamd child
root      5640  0.0  0.9  1836  596 pts/0    S+   08:42   0:00 grep spam

I killed it and then SA was able to start without any errors.
