I'm not an expert, but IMHO the safe side is non-free, unless we have a
(non debian specific) clarification from the developper.
Yet the final decision is yours, I won't reopen the bug report myself if
you feel confident about the "freeness" of this package, nor will I
bother you anymore :-)
