How is the iwl* license different from the old ipw*? It's the same story: firmware is binary-only, the rest is GPL: http://www.intellinuxwireless.org/LICENSE.iwlwifi-ucode About the dead upstream, it's a very pertinent argument, except the alternative isn't yet fit for consumption. With iwl3945 I'm getting random disconnects and bad link quality. While it's their choice to deprecate the old code before coming up with a stable replacement, this shouldn't apply to distributions. ipw* was tested for a long time, works, and the two modules can coexist.
