You can't start it, sure.

Why do we have only two choices?
I'd think not failing the install when the init start script fails would be a choice. Or not calling the init start script if port 80 is in use already (on initial install).

Having a half-installed package is harder to solve then having a non-starting daemon when there's another web server running already.
