Yes sure. The file that reports the statement 'This software is NOT distributed under an Open Source license.' is the firmware loader, that is not part of the modules. This may be a bug for the linux-wlan-ng package (the utilities) and this binary may be moved in the lwng-firmware package. Anyway this should not affect the modules. Also notice that firmware is not strictly needed, only some devices really need it (so this utility is not vital and if the license is a real problem can be removed or moved to non free).
